All persons buying my puppies will be required to sign the following contract
KEMP'S KENNELS CONTRACT FOR A PET PUPPY
This agreement is made and entered into this ______ day of _________ 20__ by and between Kemp’s Kennels and____________________________________ (Buyer), for the purpose of setting forth the terms and conditions of purchase by the Buyer of a purebred mini daschund from the litter whelped on November 7, 2009 out of Contessa Lady Vanessa Kemp and Sir Chocolate E. Cody. For $_____, the Kemp’s Kennels agrees to sell and the buyer agrees to purchase a female_____, male ____ companion puppy from the litter described above subject to the following terms.
1. Kemp’s Kennels warrants that the above described puppy is a purebred mini daschund register able with the American Kennel Club and that registration papers have been provided to the Buyer as of the date of the completed purchase, together with a true copy of its pedigree.
2. Kemp’s Kennels warrants that the above-described puppy is in good health at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian within two (2) business days (not including weekends and holidays) of receipt of puppy.
If, as a result of the examination, the Veterinarian determines that the puppy is not in good health then the Buyer shall elect to keep the puppy or return the puppy to Kemp’s Kennels for a refund. If the buyer elects to return the puppy, Buyer shall, within 10 days after the date of the signing of this contract, send to Kemp’s Kennels by certified mail a written Veterinarian's certificate stating that the puppy was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy to Kemp’s Kennels at Buyers expense. Upon receipt of the puppy, Kemp’s Kennels shall be obligated to refund all monies minus non-refundable deposit received from Buyer toward the purchase price of the puppy, and further performance under this contract shall be null and void. All action taken to return the puppy shall be done with the best interest of the puppy in mind including temperature at time of shipment, non-stop flights,
If Buyer chooses a replacement puppy, Buyer and Kemp’s Kennels shall make prompt arrangements within 10 days of receipt of certified letter and Veterinarian certification for return of the puppy sold herein to Kemp’s Kennels place of business. Buyer shall be responsible for taking good and reasonable care of the puppy until Kemp’s Kennels receives it. Costs and related expenses of returning the puppy to Kemp’s Kennels shall be the obligation of the Buyer
3. Ownership of the puppy will be transferred to the Buyer for the sale price of $________ to be paid as follows: $100.00 non-refundable deposit on execution of the Agreement with the balance of $_________ to be paid on or before the puppy leaves Kemp’s Kennels premises. If the balance is not paid by ________________________, this Agreement shall be cancelled and the Buyer forfeits the deposit given hereunder.
4. If delivery is requested by Buyer, it shall be by airfreight, C.O.D. to a designated location. Buyer is responsible for costs of crate, insurance during shipment, and cost of freight charges. If Seller Kemp’s Kennels has to purchase crate prior to shipping, Buyer shall reimburse Kemp’s Kennels in full for this cost.
5. Kemp’s Kennels has determined that the puppy is of "pet quality" and is NOT suitable for breeding. In such case, Kemp’s Kennels shall provide Buyer with Limited Registration Certificate.
6. Buyer agrees that he/she is not acting as an agent in the purchase or this puppy and that Buyer will not sell this puppy or its progeny to any agent, pet store or guard dog business.
7. Buyer agrees that if it becomes necessary to sell or otherwise dispose of this puppy, Buyer will notify Kemp’s Kennels before taking such action so that the puppy may, at Kemp’s Kennels option, be re-purchased by Kemp’s Kennels . Upon notification, the Seller shall have 15 working days to exercise said re-purchase option. Exercise shall be notice in writing sent to Buyer.
8. Buyer agrees that the puppy will reside at the home of the Buyer, have access to a fenced yard, not be chained or tethered, and will be provided with proper housing, a good quality diet, annual shots and exercise. Buyer also agrees that this puppy will not be used as a guard dog for any business. Buyer agrees that at least one basic obedience training course will be completed with the puppy.
9. The registration papers will carry a KK# at end of name - this is to track Kemp’s Kennels litter #.
This Agreement is made and signed by both parties to insure the well being and protection of this puppy. If the Buyer breaches any part of this Agreement, Kemp’s Kennels is released from any obligations under this Agreement.
